Companies that imported materials, components, or finished products between February 1, 2025 and February 20, 2026 may be entitled to substantial refunds.

Recent federal court decisions have created a major opportunity for businesses to recover tariffs paid on imported goods. On February 20, 2026, the U.S. Supreme Court held that tariffs imposed under the International Emergency Economic Powers Act were unconstitutional. Shortly thereafter, on March 2, 2026, the Federal Circuit Court of Appeals ruled that the government could not delay issuing refunds, clearing the way for what may exceed $175 billion in tariff reimbursements.

Given the scale and evolving nature of the process, businesses must act promptly to preserve their rights and maximize recovery. The process is complex, evolving, and subject to administrative and legal developments. Key considerations include:

  • Phased Refunds – The government began processing certain claims in April 2026, but eligibility varies and later phases remain undefined.
  • Ongoing Regulatory Changes – Refund guidance and procedures are constantly evolving, and additional delays, challenges, and updates are expected.
  • Statute of Limitations – Businesses have two years from when the claim accrues to take action. Missing this deadline may forfeit recovery rights.
  • Preserving Your Claim – Companies must file a complaint with the U.S. Court of International Trade to preserve claim eligibility for later refund phases.
